This Privacy Policy explains how we collect, use, share, and protect personal information when you visit www.gavanci.com, purchase our products, or otherwise interact with us. By using the site you acknowledge that you have read this policy.

For the purposes of the UK GDPR, the EU GDPR, US state privacy laws, and Canada's PIPEDA, SOGY HOLDINGS LLC is the data controller responsible for the personal information described in this policy.

We respond to privacy requests within the timeframes required by applicable law. Our support team replies to all enquiries within 24 hours.

We are established outside the United Kingdom and the European Economic Area. Data subjects in the United Kingdom and the European Economic Area, and supervisory authorities, may contact us directly at info@gavanci.com to exercise any right described in this policy or to raise any matter concerning our processing of personal information. We handle every such request under the same procedures and within the same statutory timeframes wherever it is submitted from.

Where we are required to designate a representative under Article 27 of the UK GDPR or Article 27 of the EU GDPR, the contact details of that representative will be published in this section.

3. Personal Information We Collect

The information we collect depends on how you interact with us.

Information you provide to us

  • Contact and order details: name, email address, phone number, billing address, shipping address, and the contents of your order.

  • Payment information: card and payment account details are collected and processed directly by our payment providers. We receive confirmation of payment, the payment method type, and the last four digits of the card. We do not store full card numbers.

  • Account and subscription details: account credentials where you create an account, your subscription plan, billing frequency, next charge date, and your subscription management history.

  • Marketing preferences: your email and SMS opt-in status and any preferences you set.

  • Customer support communications: the content of emails, messages, and any information you choose to include when you contact us.

  • Reviews and submissions: any review, testimonial, photograph, or other content you submit.

  • Device and network information: IP address, browser type, operating system, device identifiers, and referring URL.

  • Usage information: pages viewed, products viewed or added to cart, time on site, and interactions with the store.

Where we rely on consent, you may withdraw it at any time. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.

5. How We Share Your Personal Information

  • Payment processors. Shopify Payments, PayPal, and other payment providers, which process your payment and hold your payment credentials.

  • Checkout and offer tools. Providers that power elements of our checkout and offer presentation, currently including Kaching.

  • Subscription management. Loop Subscriptions, which manages recurring billing, the customer portal, and subscription notifications.

  • Email and SMS platforms. Omnisend, which delivers transactional and marketing messages.

  • Advertising and analytics platforms. Meta (Facebook and Instagram), TikTok, Google, WeTracked, and TrueProfit, which measure conversions, attribute orders, report on store performance, and deliver advertising.

  • Customer communication and reputation tools. Providers that assist with managing comments, reviews, and messages on our website and social media presence, currently including Brandwise.

  • Fulfilment and shipping partners. Our warehouse and shipping carriers, which receive the information needed to pack and deliver your order.

  • Professional advisers and authorities. Accountants, legal advisers, and government or law enforcement bodies where required by law or to establish, exercise, or defend legal claims.

  • Acquirers. In connection with a merger, acquisition, financing, or sale of assets, personal information may be transferred as part of that transaction.

We may add or change providers within these categories from time to time. We do not sell personal information for money.

6. Advertising, Analytics, and Sharing With Ad Platforms

We use cookies, pixels, software development kits, and server-side integrations to measure and improve our advertising and to show advertising tailored to your interests.

As part of this we share certain personal information with third-party advertising and analytics platforms, including Meta, TikTok, and Google. The information shared may include identifiers such as your email address or phone number, usually in hashed form, together with your IP address, device and browser information, and information about the pages you viewed and the purchases you made. These platforms use this information to measure conversions, build audiences, and show advertising to you and to others across their services and partner networks, in accordance with their own privacy policies.

Some of this activity is treated as a "sale" or "sharing" of personal information for targeted advertising under certain US state privacy laws, and as processing for targeted advertising under others. You have the right to opt out. See Section 9 for how to do so.

7. Cookies and Similar Technologies

We use the following categories:

  • Strictly necessary cookies, which enable core functions such as the cart, checkout, and secure login. These cannot be switched off.

  • Analytics cookies, which help us understand how the store is used and how it performs.

  • Advertising cookies and pixels, which deliver and measure advertising on Meta, TikTok, and Google.

Where required by law, including in the United Kingdom and the European Economic Area, we obtain your consent before setting non-essential cookies, and you may change or withdraw your cookie preferences at any time through the cookie banner or preference control on our site.

Global Privacy Control. We honour the Global Privacy Control (GPC) signal as a valid request to opt out of the sale or sharing of personal information for targeted advertising, where applicable law requires. The signal applies to the browser and device on which it is sent, so you will need to enable it on each browser and device you use. More information is available at https://globalprivacycontrol.org.

We do not currently respond to other "Do Not Track" browser signals.

8. How Long We Keep Your Information

We keep personal information only as long as necessary for the purposes described in this policy. Our general retention periods are:

Where information is no longer needed we delete it or irreversibly anonymise it. We may retain information for longer where required to establish, exercise, or defend a legal claim, or where a longer period is required by law.

9. Your Privacy Rights

The rights available to you depend on where you live. In all cases, contact info@gavanci.com to make a request. We may need to verify your identity before we act, and we will not treat you differently for exercising a right.

United Kingdom and European Economic Area

You have the right to request access to your personal data, to have inaccurate data corrected, to have your data erased in certain circumstances, to restrict processing, to object to processing carried out on the basis of legitimate interests or for direct marketing, to receive your data in a portable format, and to withdraw consent where processing is based on consent.

You also have the right to lodge a complaint with a supervisory authority. In the UK this is the Information Commissioner's Office (ico.org.uk). In the EEA this is the data protection authority in your country of residence.

United States

Depending on your state of residence, including but not limited to California, Virginia, Colorado, Connecticut, Texas, Oregon, Montana, and others as such laws come into effect, you may have the right to know what personal information we hold about you and how it is used, to request deletion, to request correction, to obtain a portable copy, and to opt out of the sale or sharing of your personal information and of processing for targeted advertising.

If we decline a request, you may appeal by replying to our decision. If you remain dissatisfied you may contact your state Attorney General.

We do not sell sensitive personal information, and we do not use sensitive personal information to infer characteristics about you.

Canada

Under PIPEDA and applicable provincial legislation, including Quebec's Law 25, you have the right to access the personal information we hold about you, to request correction of inaccurate information, and to withdraw consent to the collection, use, or disclosure of your information, subject to legal and contractual restrictions. You may also complain to the Office of the Privacy Commissioner of Canada or to your provincial privacy regulator.

Australia

Under the Privacy Act 1988 and the Australian Privacy Principles you may request access to the personal information we hold about you and ask us to correct it. If you are not satisfied with how we handle a request you may complain to the Office of the Australian Information Commissioner.

10. International Transfers

We are based in the United States and our service providers operate in the United States and other countries. This means your personal information may be transferred to, stored in, and processed in a country other than the one you live in, including countries whose data protection laws differ from those of your own.

Where we transfer personal information out of the United Kingdom or the European Economic Area, we rely on recognised safeguards, including the European Commission's Standard Contractual Clauses and the UK International Data Transfer Addendum, or transfers to countries subject to an adequacy decision. 11. Email and SMS Communications

Transactional messages. When you place an order or start a subscription we send messages that are necessary to perform our contract with you, including order confirmations, subscription confirmations, pre-charge notices, renewal reminders, shipping and tracking updates, and delivery notifications. These are not marketing messages and you will continue to receive them for as long as you have an active order or subscription.

Marketing messages. Where you have opted in, we may send marketing emails and text messages, including promotional offers, product announcements, abandoned cart reminders, and review requests.

Consent to marketing is not a condition of purchase. Message frequency varies. Message and data rates may apply to text messages, and your mobile carrier is responsible for those charges. Carriers are not liable for delayed or undelivered messages.

You may unsubscribe from marketing emails using the unsubscribe link in any email, and from marketing texts by replying STOP to any message. Reply HELP or contact info@gavanci.com for assistance. Opting out of marketing does not stop transactional messages relating to your existing orders or subscription.

Your mobile number and SMS consent status are shared only with the vendors that operate our messaging service, such as our messaging platform and telecommunications providers. We do not share, sell, rent, or otherwise disclose mobile phone contact information or SMS opt-in data to third parties for their own marketing or promotional purposes.

12. Fraud Prevention and Payment Disputes

We maintain records of your order, your subscription enrolment, the notices we sent you, your acceptance of our terms at checkout, delivery tracking, and our correspondence with you.

Where a payment dispute or chargeback is raised, we may present that documentation to our payment processors, the card networks, and your card issuer in order to establish, exercise, or defend a legal claim. We reserve the right to challenge disputes where our records show that the order was delivered, that the applicable terms were disclosed and accepted, or that our payment systems have been misused.

If you do not recognise a charge or believe there has been an error, please contact us first at info@gavanci.com. We resolve the large majority of billing questions quickly and a direct request is almost always faster than a dispute, which can take a payment provider several weeks to resolve.

13. Reviews, Testimonials, and Content You Submit

If you submit a review, testimonial, photograph, or other content, you grant us the right to use, reproduce, and display it in our marketing and on our website and social media. Please do not include personal information in a submission that you do not want to be publicly visible. Testimonials reflect individual experiences and are not a guarantee of results.

14. Children's Privacy

Our products are intended for adults. This website is not directed at, and our products are not sold to, anyone under 18 years of age, and we do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us with personal information, contact info@gavanci.com and we will delete it.

We have no actual knowledge that we sell or share the personal information of anyone under 16 years of age.

15. Security

We use appropriate technical and organisational measures to protect personal information, and we rely on Shopify and our other providers to maintain encryption and industry-standard safeguards for the data they process on our behalf.

No system is completely secure and no transmission over the internet can be guaranteed. Please do not send us sensitive information through insecure channels. You are responsible for keeping your account credentials confidential.

16. Data Breach Notification

If a personal data breach occurs that is likely to affect your rights, we will notify the relevant supervisory authority and, where required, affected individuals, without undue delay and in accordance with applicable law.

17. Third-Party Websites and Links

Our website may link to third-party sites and platforms, including social media networks and payment providers. We do not control those sites and are not responsible for their privacy practices. Review their policies before providing personal information.

18. Changes to This Policy

We may update this Privacy Policy to reflect changes to our practices or for operational, legal, or regulatory reasons. The revised policy will be posted on this page with an updated "Last updated" date, and we will provide additional notice where required by law.
